Real News – Easements

The Sock Drawer Easement is the rarest of the real estate easements. It is the unobstructed ingress and egress, with no limitations whatsoever, granted to my family to directly approach my top dresser drawer, the sock easement.

dekruiff_webThis easement has not always existed. As my children grew, the easement they currently enjoy also grew. One by one, each one discovered my fabulous sock collection. The sporty kind are mostly white, 60 to 70 percent cotton and cut just above the ankle. When I wear my big boy clothes, they are mid-calf, black, 50 percent cotton. None have holes, nor stains, nor any imperfection, less they make the donation bin.

Now, everyone has a “thing.” Mine, The Holy Grail, is a new, never warn pair of socks—something I have not attained ever since the Sock Drawer Easement was notoriously adopted by my family over the last few years.

In Commercial Real Estate, much like The Sock Drawer Easement, rights are granted to or sometimes taken by others to use a portion of some other owner’s real estate.

The most common commercial easement is a utility easement. Utility companies are given the right to run lines and access equipment for maintenance and such.

Some easements are created when someone uses land without authority, but have used the property in a hostile, continuous and open manner for a number of years, called Easement by Prescription, such as the Sock Drawer Easement.

So the next time PN readers see any members of my family, ask them about easements. And ask them to stop walking outside without shoes when they are wearing my socks.
